My Dear Friend & POTUS, JRB,
Thanks for writing the Opinion piece that appeared in the WP on Monday. It would have been easier to compose a couple of tweets. Do we still call them that?
Writing 657 words in 12 paragraphs of more or less complete sentences requires focus & energy. I am trying to write 2000 words for a conference proposal & am finding it challenging.
Regarding your proposals, I am fully on board with the idea of reforming the Supreme Court, but have some questions. Are you sure we need to amend the Constitution to clarify that no one is above the law. Isn’t that idea embedded into the fabric of the document? Besides, won’t that take forever?
I love the idea of a term limit. According to www.supremecourt, “The average number of years that Justices have served is 16,” so 18 years seems to be the right # of years for the justices to get in a groove & do a good job. The idea of having an appointment every two years would prevent the shenanigans the GOP employed to pack the court with 45’s appointees. What do we need to do to get this going?
I like the idea an enforceable code of conduct, but am wondering how that would work. Who would do the enforcing? The other judges? A randomly selected group of citizens? Leaders from other countries? I wish we could depend on the moral compass of the brilliant legal minds who sit on the SCOTUS, but clearly, that’s not the case.
As you are thinking of our legal system, please also think about the legal systems in places like Ukraine, Burma & Gaza. What kind of legal system will help them to heal once the violent conflicts end in their environs? How big should their supreme courts be? Should the judges be elected or appointed? How long should they serve? All of these questions make me wonder how our founding elders decided on the structure of our SCOTUS & how long it took them to figure it out?
